Council of Europe Codifying Standards for the Administrative Detention of Migrants
The GDP submitted written comments to the Council of Europe’s European Committee on Legal Co-operation as part of its consultation on drafting a legal instrument codifying existing standards related to the conditions of administrative detention of migrants. The GDP’s submission raised concerns about the committee’s reliance on the European Prison Rules for establishing immigration detention standards, provided guidance on differentiating between penal and administrative detention, and dispelled confusion over detention terminology and concepts. More information about the codifying exercise is available here.
